1.1. By visiting, using or purchasing goods on the e-shop https://balticchinchillas.com (hereinafter referred to as the e-shop), the buyer agrees to the terms and conditions of the e-shop purchase and sales agreement (hereinafter referred to as the Agreement).
1.2. The seller of the goods and the website administrator is MB Baltic Chinchillas (hereinafter - the Seller), legal entity code 306093594, registered office address Laisvės pr. 88, LT-06125, Vilnius.
1.3. Buyers of the goods can be all natural persons, who are not restricted by a court, as well as legal entities purchasing goods for personal use (hereinafter referred to as the Buyer).
1.4. This Agreement is a legal document for the Buyer and the Seller (hereinafter together - the Parties), which establishes the rights, obligations and responsibilities of the Parties, obligations for the Buyer when purchasing goods in the e-shop and the Seller executing the order submitted by the Buyer in the e-shop.
1.5. The Agreement between the Parties shall be deemed concluded from the moment the Buyer clicks the “Order” button in the checkout and receives order confirmation via email provided.
1.6. The Seller has the right to change, amend or add to the terms and conditions of the Agreement at any time. When the buyer places an order in the e-shop the terms and conditions of the Agreement are valid at the time the order was placed, therefore the Buyer assumes full responsibility to check the terms and conditions of the Agreement each time he is using the e-shop and placing and order.
2. Buyer, buyer rights and responsibilities.
2.1. The Buyer has the right to purchase the goods from the e-shop as long as he complies with the terms of this Agreement.
2.2. The terms of this Agreement apply to the Buyer without exception, therefore the Buyer must read and comply with them.
2.3. The Buyer orders the goods by providing the necessary Personal Data during the checkout.
2.4. The Buyer has the right to cancel the submitted order until he receives the notification that the goods were shipped from the Seller.
2.5. The Buyer confirms with this Agreement that he is acquainted that food products of appropriate quality are not exchanged or returned in accordance with the Retail Trade Rules approved by the Government of the Republic of Lithuania.
2.6. The buyer undertakes to pay the agreed price for the ordered goods.
2.7. The Buyer must immediately inform the Seller if the goods were delivered in damaged packaging and / or goods or quantity received does not match goods ordered.
2.8. Upon receiving the goods, the buyer must make sure that the packaging is not damaged. In case of external damage, the buyer must immediately (the next day at the latest) inform the seller by email info@balticchinchillas.com. If the seller is not informed, it is considered, that the buyer confirms that the goods have been delivered in good condition and without any damage. Failure to do so shall release the Seller from liability to the Buyer for the quality of the goods, which is related to damage to the packaging during delivery.
2.9. Any content published in the e-shop is protected by copyright and other intellectual property rights, and in case of infringement is protected in accordance with the laws of the Republic of Lithuania. Therefore the Buyer undertakes responsibility not to use the intellectual property for commercial or any other purposes.
3. Rights and obligations of the seller.
3.1. The Seller undertakes to create all conditions for the Buyer to use e-store services, but the Seller shall not be held liable if the e-store would be unavailable for a certain period of time due to reasons dependent on or outside the control of the Seller.
3.2. The Seller undertakes to deliver the goods ordered by the Buyer in the manner chosen by the Buyer within the specified period in the territory of the Republic of Lithuania, taking into account the provisions of Chapter 5 of this Agreement.
3.3. The Seller undertakes the responsibility to provide accurate description about the products to the Buyer.
3.4. If the Buyer tries to disrupt the Seller's e-shop stability, security or violates his obligations, the Seller has the right to immediately and without notice restrict or suspend the Buyer's access to the e-shop.
3.5. The Seller has the right to change the characteristics of the goods and other related information about the nature of the goods sold without any prior notice to the Buyer, therefore the Buyer assumes full responsibility if the descriptions of the selected goods were not checked again before placing the order.
3.6. The Seller has the right to change, amend or add to the terms and conditions of the Agreement at any time. When the buyer places an order in the e-shop the terms and conditions of the Agreement are valid at the time the order was placed, therefore the Buyer assumes full responsibility to check the terms and conditions of the Agreement each time he is using the e-shop and placing and order.
4. Ordering, prices, payment, deadlines.
4.1. In the e-shop the Buyer can buy 24 hours a day, 7 days a week, subject to 3.1 of this Agreement.
4.2. Product prices in the e-shop and in the received order confirmation are shown in euros with VAT.
4.3. The website shows all goods sold by the Seller. If the Seller does not have an item at a given time, it is not possible to add such item to the cart.
4.4. After completing the order an order confirmation will be sent to the Buyer's email address.
4.5. Payment for the goods can be made through the payment platform Paysera or by bank transfer. If the Buyer wishes to pay in cash when picking up the goods, he must inform the Seller by email info@balticchinchillas.com and get his confirmation before placing the order.
4.6. After selecting payment by bank transfer, the Goods are ready for shipment when the money is received in the Seller's account. If the Buyer does not pay the received invoice within 5 days, the order is canceled and the purchase-sale agreement is considered not to have been concluded.
4.7. The Seller undertakes to send the goods within 1-3 working days from the moment he received payment for the goods. If for any reason the Seller is unable to send the goods within the specified period, he must inform the Buyer and agree with the Buyer on the expected delivery time. If the Buyer is not satisfied with the delivery time offered by the Seller, the Seller must immediately return the money paid to the Buyer.
5. Delivery.
5.1. The goods can be delivered int the territory of the Republic of Lithuania via Omniva or LP Express Parcel Machines.
5.2. Shipping on orders of 40 € or more is free of charge. Orders less than 40 €, are charged 3 € for shipping. Orders are usually delivered within 2-3 working days after dispatch, but the deadline may vary depending on the selected shipping provider.
5.3. The buyer must make sure that he has chosen the right Parcel Machine for delivery. If the chosen Parcel Machine is incorrect, the costs occured for the return and re-dispatch of the goods shall be borne by the Buyer.
5.4. In all cases the Seller is not liable for the violation of the deadlines when delivering the goods, or if the goods are not delivered due to the fault of the Buyer or third parties or due to circumstances beyond the Seller's control.
6. Quality, returns and exchange of the goods.
6.1. The e-shop sells only high-quality, original and correctly labeled products.
6.2 Description, characteristics and other details for each product sold on the e-shop are specified in product detail page.
6.3. The seller is responsible for ensuring that all goods sold in the e-shop comply with the legal requirements.
6.4. According to the retail trade rules approved by the Government of the Republic of Lithuania, food products of appropriate quality are non-refundable and non-exchangeable.
6.5. The Buyer may cancel the submitted order until he receives the Seller's notification that the goods were shipped.
6.6. The seller is not liable for defects in the goods, damage to the goods or loss of the goods due to the actions or omissions of third parties. The limits of the seller's liability also exclude defects in the goods resulting from the misuse of the goods.
6.7. A product is considered to be of good quality if it matches characteristics described in the e-shop product details page, if it has not expired, if it does not contain substances prohibited by law, if the packaging of the product is not damaged and if the appearance, smell or consistency of the product has not changed.
6.8. If the Buyer has received a product of poor quality, he has the right to demand that the product is replaced with a product of the appropriate quality or return the product and get a refund for the product.
6.9. If he Buyer receives defective product, he must notify the Seller within 14 days by email info@balticchinchillas.com or telephone + 370 6 562 86 00 of the receiving such product. In the notification, the Buyer must provide product name, order number, Buyers name and surname and the defects. The buyer is responsible for providing the correct information in the notification.
6.10. Upon receiving written notice, the Seller commits to contact the Buyer within 3 working days.
6.11. If the Buyer chooses to return the goods and get the refund, the Seller will return the money to the account from which the payment was made within 7 working days of receiving the goods back.
6.12. If the Buyer chooses to exchange poor quality product with the same product of good quality, the Seller must deliver the goods at his own expense.
6.13. If the Buyer is not satisfied with the proposed solution and / or the Buyer does not agree otherwise with the Seller, he has the opportunity to submit a request or complaint to the Consumer Rights Protection Service (www.vvtat.lt) or fill in the request form on the Onlne Dispute Resolution platform.
7. Liabilities of the buyer and the seller.
7.1. The buyer is responsible for his actions when using this e-shop.
7.2. The Buyer is fully responsible for the accuracy of the Personal Data he provides. If the Buyer does not provide accurate personal data during the checkout, the Seller is not responsible for the consequences and acquires the right to claim compensation for directly incurred losses.
7.3. The Seller is exempt from any liability in cases where the loss arises due to the fact that the Buyer, notwithstanding the Seller's recommendations and the Buyer's obligations, did not read the provisions of the e-shop Agreement, although he was given such opportunity.
7.4. If the Seller's e-shop contains links to other websites, the Seller is not responsible for the information or services provided there. The seller does not maintain or represent those websites.
7.5. The seller uses the delivery services of third parties. Third parties providing delivery services have their own terms and conditions, privacy policy and therefore the Seller does not regulate the content or services provided by these service providers and is not responsible for any actions of these service providers and the consequences arising from them.
7.6. The services provided by the the Seller does not include any financial or payment related services, therefore, every time the Buyer makes a payment to the Seller for the ordered goods, the Buyer uses the third party services. The seller is not responsible for any consequences or losses that arise from these services.
7.7. The seller is not liable for any damage or loss arising from the services provided by the third parties, including but not limited to the delivery services. It is Buyer obligation to get acquainted with the Privacy Policy, Terms and Conditions or any other necessary information provided by the third parties. The buyer undertakes the responsibility to act accordingly to the rules provided by the third parties.
7.8. Claims, complaints, demands, accusations, observations, questions, inquiries regarding third party service provsion, performance, disruption etc. are not Seller's responsibility and therefore must be addressed directly to the third party service provider.
7.9. In the event of damage, the guilty Party shall compensate the other Party direct losses.
8. Processing of buyer data.
8.1. The seller has the right to receive information identifying the Buyer, to the extent required by the terms and conditions of this Agreement. In this case, the Buyer's personal data is used only for the purposes of concluding and executing the Agreement in electronic form.
8.2. The personal data provided by the Buyer is processed in accordance with the requirements of the the Law on the Legal Protection of Personal Data of the Republic of Lithuania and other legal acts of the Republic of Lithuania regulating the processing and protection of this data.
8.3. The Buyer's personal data for direct marketing purposes is processed only with the Buyer's consent.
9. Marketing and Notifications.
9.1. The seller may may initiate at its own discretion special deals on the e-shop.
9.2. The seller has the right to change or cancel special deals without separate notice. Any change or cancellation made to special deals is only valid in advance, that is from the moment it was changed.
9.3. The Seller sends all notifications to the Buyer email specified during the checkout.
9.4. All questions to the Seller are sent to the email specified in the “Contacts” section of the e-shop.
9.5. The Seller shall not be liable if the Buyer does not receive the sent notification or confirmation messages due network connection or email service providers issues.
10. Final Provisions.
10.1. This e-shop Agreement is concluded in accordance with the laws and legal acts of the Republic of Lithuania.
10.2. All disputes arising when carrying out this Agreement are settled by negotiation. If the dispute cannot be resolved in such manner, it may be resolved using the Online Dispute Resolution platform supervised by the European Commission or in accordance with the laws of the Republic of Lithuania.
